The customer is at least 18 years old or has the consent of their legal representative. Once digital products have been provided or activated, cancellations, returns and exchanges are generally excluded.
These General Terms and Conditions (GTC) apply to all orders and contracts between Offerz AG ("Offerz") and its private or business customers domiciled in Switzerland or Liechtenstein, concluded via offerz.ch, the Offerz app or any other ordering channel offered by Offerz. Additional or deviating terms may apply to business customers.
The customer must be made aware of these GTC before completing an order and must be able to view, download and save them. By submitting an order, the customer confirms acceptance of these GTC. In addition, the terms of the respective issuer, content provider or partner made accessible prior to purchase shall apply.
The presentation of products does not constitute a legally binding offer, but a non-binding invitation to order. By submitting an order, the customer makes a binding offer to conclude a contract. The contract is only concluded once Offerz accepts the order, in particular through delivery, activation or enabling of the product.
Offerz may review orders prior to acceptance in accordance with Clause 5 and reject them for objective reasons, in particular in the event of unavailability, security concerns, incorrect information, technical errors or a breach of these GTC. If an order is rejected, no contract is concluded.
The prices displayed in the online shop or app at the time of ordering apply. Prices are stated in Swiss francs and include statutory VAT where applicable. Fees, surcharges and discounts are displayed before the order is completed.
Prices are daily prices. Subsequent price changes do not give rise to any claim to adjustment of orders already concluded. Changes to prices, range and availability are reserved.
Offers are valid while stocks last or while available online. Errors, technical mistakes as well as printing and typing errors are reserved. The range and availability in the app may differ from the offering on offerz.ch.
If a product is no longer available in the ordered denomination, Offerz may deliver an equivalent product, provided this does not result in any significant disadvantage to the customer. For example, two vouchers worth CHF 50 each may be delivered instead of one voucher worth CHF 100, provided this does not make redemption more difficult.
Delivery is made digitally. Physical shipping only takes place if expressly stated for the relevant product.
For a purchase for oneself, digital products, for example codes, number sequences or activation links, are made available via the Voucher Wallet or displayed on screen. Security checks pursuant to Clause 5 remain reserved.
Purchased products generally remain accessible via the Voucher Wallet for at least two years. The customer is responsible for viewing the products themselves and saving them permanently if required. The products themselves are generally not sent by e-mail. E-mail may only be used to inform about their availability.
Products that are obviously delivered incorrectly must be reported to customer service no later than 24 hours after they are made available. Mandatory statutory claims remain reserved. Products delivered in excess or provided multiple times may be charged retroactively or blocked, unless the customer could reasonably assume they were entitled to receive them free of charge.
In the case of a gift purchase, the buyer does not receive access to the purchased product. It is made available to the recipient via a link. The terms applicable to gift purchases apply in addition.
The delivery times stated for the product apply. Delivery of a product may be delayed by up to 14 days, for example in the event of technical issues. This does not entitle the customer to withdraw from the contract.
The available payment methods are shown during the payment process. Offerz may exclude individual payment methods for objective reasons for certain customers, customer groups, products or orders. Any fees or discounts are displayed prior to payment.
Products available for pre-order must be paid for at the time of ordering. Offerz may check payments for origin and legality pursuant to Clause 5 and reject or reverse them in the event of justified security concerns.
The use of payment methods belonging to third parties is prohibited without the specific consent of the rightful holder. If the person placing the order and the holder of the payment method differ, Offerz may request evidence and withhold the order until the matter has been clarified.
Payments are processed in encrypted form. For credit card payments, 3-D Secure verification is required.
For bank transfers, the correct order reference must be provided. Payments that cannot be clearly assigned may be withheld until clarification. In the absence of an order reference, the customer must prove the assignment of the payment by means of suitable payment evidence.
Unjustified chargebacks or reversals may be charged to the customer at the amount of the actual and reasonable expenses incurred. Fees pursuant to Clause 10 remain reserved.
Upon redemption, Offerz vouchers are transferred as a balance to the customer account. The balance is used to pay for future orders. If it is insufficient, the remaining amount may be paid using another available payment method.
A maximum balance of CHF 3,000 may be held per customer. The balance is valid indefinitely. However, after 24 months of inactivity, a monthly processing fee of CHF 3 is charged. Five years after the initial top-up, the entire balance will nevertheless expire.
The balance does not bear interest and is generally not paid out in cash. Offerz may offset due and undisputed claims against the balance.
In the event of proven fraud or serious misuse, Offerz may block the customer account.
Offerz vouchers may not be purchased using an Offerz balance. Discounts may not be applied to Offerz vouchers.
The customer must adequately protect their account, in particular by using a secure password. Offerz is not liable for misuse of the Offerz balance.
Offerz reviews orders in an automated manner and, where necessary, manually based on risk-based criteria. These criteria may be adjusted in order to detect fraud, money laundering, misuse of payment methods, extortion and comparable risks.
In the event of specific irregularities, Offerz may carry out a security check and withhold delivery until the check has been completed. In particular, Offerz may check whether:
Offerz may request the documents and information that are necessary and proportionate for the specific check. These may include, in particular, identity documents, proof of payment, proof of address, screenshots or other suitable documents. Data that is not required should be capable of being redacted, provided this does not compromise the purpose of the check.
If the customer does not respond within the reasonable period set, generally no later than seven days after being requested to do so, Offerz may keep the order pending or reject it.
If there is a justified suspicion of a criminal offence or a statutory duty to report, Offerz may inform the competent authorities or bodies. The processing and disclosure of personal data is carried out in accordance with the applicable data protection provisions.
Offerz may refuse delivery or reverse an order at the customer's expense if there are concrete indications that the products are intended to be used for a criminal offence or that the customer could be directly at risk of becoming a victim of fraud. In the event of fraud, a refund may be made conditional on suitable evidence, in particular confirmation of a police report.
Where there is a serious and specific risk to a person in need of protection, Offerz may, within the legally permissible framework, inform the competent authority (e.g. the child and adult protection authority, known in German as the KESB).
Once a digital product has been made available, displayed, enabled or activated, cancellation, exchange and return are generally excluded.
Prior to delivery, Offerz may, at its due discretion, permit an exchange or cancellation. There is no entitlement to this.
Offerz may cancel orders for objective reasons, in particular in the event of unavailability, technical errors, security concerns or a breach of these GTC.
If the customer is culpably responsible for the cancellation, they may be charged the actual, reasonable and demonstrable expenses incurred, or the flat fee agreed under Clause 10. If the flat fee is higher than the actual damage or expense incurred, the customer may prove the lower amount. In the event of a cancellation attributable to Offerz, Offerz shall bear its own costs.
When selling vouchers, value cards, balances and comparable price-bound products, Offerz generally acts as an intermediary between the customer and the respective issuer or content provider. For other products, Offerz acts as the seller.
The use of a product is additionally subject to the terms of the relevant provider made accessible prior to purchase. It is the customer's responsibility to check the requirements stated there, such as minimum age, country restrictions or technical requirements.
Additional identity, age or security checks may be required for certain products. Offerz is not liable if a correctly delivered product cannot be used due to unmet conditions on the part of the provider.
Offerz processes the customer data required for ordering, delivery, customer service and security checks. This may include, in particular, name, address, e-mail address, phone number, IP address, date of birth and, where applicable, device data (user agent, languages).
The customer is obliged to provide accurate and complete information. In the event of incorrect information, Offerz may withhold or reject the order until the matter has been clarified. Prior to a cancellation, the customer is generally given the opportunity to correct their information, provided this does not jeopardize the purpose of the security check.
The use of VPN, proxy, hosting or comparable services during an order may trigger a security check if this conceals the location, identity or origin of the connection. Such services may not be used when placing an order.
Customers may only use their own identity, their own identity documents and, generally, their own phone number. In the event of a specific suspicion of misuse, affected and demonstrably linked accounts may be blocked. Offerz is not obliged to inform the customer of an account closure or of measures taken in the background.
In principle, only one customer account is permitted per person. Additional accounts may be blocked or merged.
The privacy policy forms part of these GTC.
Contractual, security and service information may be delivered via the communication channels specified by the customer, insofar as this is necessary for the performance of the contract or the protection of the account.
Promotional messages are only sent within the scope of the applicable statutory requirements. Where consent is required, it may be revoked at any time with effect for the future. Revocation does not affect necessary contractual and security notifications.
Offerz may charge the following fees, provided the customer is responsible for the underlying expense:
These fees serve as a flat-rate settlement of the expense or damage typically incurred and do not constitute a contractual penalty. The customer may prove that no expense or damage, or a significantly lower expense or damage, was incurred. Offerz may assert any further proven damage insofar as this is legally permissible.
Due claims may be offset against refunds or other due claims of the customer. Offerz may reduce fees in individual cases or waive them entirely.

Offerz is liable in accordance with statutory provisions for damage that Offerz has caused intentionally or through gross negligence. Liability for slight negligence is excluded insofar as legally permissible.
Offerz is not liable for damage arising from incorrect information provided by the customer, the unauthorized use of third-party identities or payment methods, the disclosure of codes to third parties, or the use of a correctly delivered product by third parties, provided Offerz did not cause the damage intentionally or through gross negligence.
A replacement will be provided if Offerz demonstrably delivered a different product than the one ordered. The product name, amount and essential characteristics stated at the time of order shall be decisive.
The limitations of liability do not apply insofar as mandatory law prescribes more extensive liability.
In the case of advance payments, no price guarantee is given if payment is not received within five days of the order.
Attempts at deception, fraud and other misuse may be reported to the competent authorities.
Refunds in the case of suspected fraudulently induced payments may be made conditional on suitable evidence and a report to the authorities.
If a confirmation of a police report is received more than three months after payment, Offerz may, as a goodwill gesture, provide a digital Supergutschein.
Product texts, product information, redemption instructions and terms of use in the German language shall prevail in the event of discrepancies in translations. Mandatory statutory information obligations in other languages remain reserved.
Should any provision of these GTC be invalid, the remaining provisions shall remain valid. The invalid provision shall be replaced by the applicable statutory rule. Automatic replacement with a clause as similar as possible shall only take place insofar as this is legally permissible.
Offerz may amend these GTC for objective reasons, in particular in the event of changes in the law, new products, technical developments or adjustments to business processes.
For individual orders, the version of the GTC accepted at the time the contract was concluded shall generally apply. Amendments shall apply to future orders from the date of their publication.
Swiss law applies.
The place of jurisdiction is Thun (BE), subject to any mandatory statutory places of jurisdiction, in particular for consumers.
Offerz Plus is a free loyalty program for Offerz's end customers. Business customers are excluded from participation. The minimum age is twelve years. Minors require the consent of their legal representative.
Participation requires a valid Offerz customer account as well as acceptance of these Offerz Plus terms.
Participants can collect points through purchases and other designated activities. The number of points available may vary depending on the product, product group, promotion, customer and period. The offers applicable at any given time are shown in the Offerz account.
Points are generally credited once an order has been fully delivered and completed.
Offerz may correct or reverse points for objective reasons, in particular in the event of cancellations, refunds, posting errors, technical errors, duplicate credits or misuse. Credits granted voluntarily do not give rise to any entitlement to further credits.
Offerz Plus points have no monetary value, do not bear interest, are not paid out, and may not be sold or transferred.
For all existing points to remain valid, within each twelve-month period the participant must use at least 10% of the points balance existing at the start of that period for rewards or other intended redemptions.
If less than 10% is used within this period, all points existing at that time shall expire upon expiry of the twelve months. Offerz will indicate the relevant period and any impending expiry in the customer account or in another suitable form.
Example: If a participant has 10,000 points at the start of the relevant period, they must use at least 1,000 points within twelve months. If they use fewer than 1,000 points, all points existing at the end of the period shall expire.
Expired points are not paid out or replaced. Corrections in the event of proven technical errors remain reserved.
Quests are time-limited tasks or missions. The participant must actively take part and fulfil the stated requirements within the specified period.
Rewards may include, in particular, points, point multipliers or prizes. They must be manually collected or activated after successful completion. No automatic credit takes place. Different quests may be offered to different participants.
Rewards are offered by Offerz or a partner and can be redeemed with points but cannot be purchased directly. They are available only while stocks last or until the specified end date.
Rewards may include, in particular, discounts, free products, partner offers, competition entries, and digital or physical services. The redemption terms and any expiry date are indicated for the relevant reward.
There is no entitlement to a reward that is no longer available. Responsibility for redemption and performance in relation to a partner generally lies with that partner. Statutory claims against Offerz remain reserved.
Offerz may temporarily offer a digital slot machine. The number of points indicated prior to participation is staked per game.
Allocation takes place on a random basis according to predefined winning chances and prizes. Offerz may correct a win within 24 hours if there is a demonstrable technical error, malfunction, incorrect allocation or manipulation.
The slot machine may only be offered insofar as its specific design is permissible under applicable law. There is no entitlement to its permanent availability.
Offerz may temporarily offer a digital scratch card. This card is opened virtually with an already predefined prize (no win, free points, free products, discounts, competition entries).
Participation may be tied to various criteria, such as certain activities (logins, orders, purchased or non-purchased products, etc.).
Necessary information relating to Offerz Plus, points, rewards, security and account changes may be delivered by e-mail, push notification or SMS.
Promotional messages regarding new rewards, promotions, ranges or offers are only sent within the scope of the applicable statutory requirements. Any marketing consent given may be revoked at any time with effect for the future.
Place of residence, age and gender may only be shared with partners in anonymized or sufficiently aggregated form, such that no conclusions can be drawn about individual participants. The privacy policy applies in addition.
The current points balance is visible in the Offerz account. Obvious errors should, where possible, be reported within 24 hours so that they can be reviewed promptly. Failure to meet this deadline does not result in the loss of mandatory statutory claims; however, a later report may make the review more difficult or impossible.
In the event of proven misuse, Offerz may correct or delete points or rewards obtained unlawfully and exclude the participant, temporarily or permanently, from Offerz Plus and from Offerz itself. In serious cases, the customer account may also be blocked in accordance with these GTC, and any discounts granted may be reclaimed.
In particular, the use of multiple Offerz accounts to obtain free points, rewards or quests for the purpose of multiple participation shall be considered serious.
Offerz may adjust, restrict or discontinue Offerz Plus, point values, quests, rewards and individual functions for objective reasons.
Significant adverse changes will be announced in an appropriate manner prior to their entry into force. In the event of a complete discontinuation of the program, a reasonable period will generally be granted for the use of existing points, provided no misuse has occurred and mandatory law does not require otherwise.
These GTC enter into force upon publication and replace the previous version for future orders and, insofar as announced accordingly, for the future use of Offerz Plus.
